By accessing or using Everpic, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Description of Service

Everpic is a platform that connects event photographers with customers using AI-powered facial recognition technology. Our service allows:

• Users to find photos of themselves at events using a selfie
• Users to purchase photos from photographers
• Photographers to upload and sell their event photos

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. User Conduct

You agree not to:

• Use the service for any illegal purpose
• Upload content you don't have rights to
• Attempt to circumvent security measures
• Use automated systems to access the service without permission
• Harass or harm other users
• Upload malicious content or malware

5. Photographer Terms

If you use Everpic as a photographer:

• You retain ownership of your photos
• You grant Everpic a license to display, process, and distribute your photos
• You are responsible for having necessary rights and releases for your photos
• You agree to our commission structure (currently 15% per sale)
• Payouts are processed according to our current payout schedule

6. Purchases and Payments

All purchases are final. Refunds may be issued at our discretion for technical issues. Prices are set by photographers and may change without notice.

7. Intellectual Property

The Everpic platform, including its design, features, and technology, is owned by Everpic. Users retain ownership of content they upload. By uploading content, you grant Everpic a license to use it for providing our service.

8. Facial Recognition

By using our face search feature, you consent to facial recognition processing of your selfie. Selfies are processed temporarily and not stored.

9. Privacy

Your use of Everpic is also governed by our Privacy Policy, which is incorporated into these terms.

10. Disclaimers

Everpic is provided "as is" without warranties of any kind. We do not guarantee the accuracy of facial recognition or the availability of specific photos.

11. Limitation of Liability

To the maximum extent permitted by law, Everpic shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service.

12. Termination

We may suspend or terminate your account at any time for violations of these terms. You may delete your account at any time through your account settings.

13. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify users of significant changes.

14. Governing Law

These terms are governed by the laws of Argentina. Any disputes shall be resolved in the courts of Buenos Aires, Argentina.
